The present matter filed by the Complainant herein came up for hearing on
18.06.2024, 09.07.2024, 06.08.2024 and 29.08.2024 before this Authority and none
appeared for Complainant and the Respondent and, this Authority passes the
following ORDER:

The present Complaint has been filed by the Complainant under Section 31
of the Real Estate (Regulation & Development) Act, 2016 read with Rule (hereinafter
referred to as the “Act”) read with Rule 34(1) of the Telangana Real Estate (Regulation
and Development) Rules, 2017 (hereinafter referred to as the “Rules”) seeking
appropriate relief against the Respondent.

Complainant and the Respondent were called for hearing on 18.06.2024
wherein both parties appeared in person. The Complainant reiterated the contents
of the complaint and prayed for handover of her flat immediately, whereas the
Respondent orally submitted that he would complete the pending works within a

period of one month and sought time for filing a detailed reply. Accordingly, the
matter was adjourned to 09.07.2024 and both parties were duly informed of the
same. However, on 09.07.2024, both parties were absent. Matter was accordingly
adjourned to 06.08.2024. On 06.08.2024, both parties failed to appear, yet again.
Matter was called for hearing on 29.08.2024, where both parties failed to appear
again.

This Authority observes that enough opportunities have been afforded to the
Complainant to appear and submit before this Authority. Given the Complainant's
consistent absence, it is apparent that the Complainant does not seek to pursue the
matter. In lieu thereof, the present Complaint stands dismissed for non-prosecution.

If aggrieved by this Order, the parties may approach the TS Real Estate
Appellate Tribunal within 60 days from the date of receipt of this Order.
