BEFORE TELANGANA REAL ESTATE REGULATORY AUTHORITY

ORDER
The present matter came up for hearing on 02.11.2023, wherein both
parties appeared and expressed their consent for an amicable settlement
through conciliation.

Subsequently, after due discussions and deliberations, both parties
have resolved their dispute pertaining to the subject matter of the complaint
and requested this Authority to dispose of the matter as settled.

On 22.02.2024, a Deed of Settlement was filed by the International
Arbitration & Mediation Centre (IAMC), stating that the dispute between the
parties has been amicably settled. In light of this, the parties expressed their
desire to withdraw the complaint filed before this Authority.

Upon perusal of the Deed of Settlement, it is observed that both parties
have agreed to purchase a new flat in the same project, entering into a fresh
agreement on the same terms as contained in the original agreement. The
flats agreed upon will be handed over to the Complainants by June 2024. Any
balance amount, if due, will be payable by the Complainant at the time of
registration of the flats.

Both parties have further agreed that they have no outstanding claims
against each other concerning the subject matter of this complaint.

In view of the submissions made by both parties and the Deed of
Settlement placed on record, the present complaint has become infructuous
and is thus disposed of. However, liberty is granted to the Complainant to
initiate fresh proceedings in the event of any default on the part of the
Respondent.

The complaint stands disposed of in terms of the Deed of Settlement.

In the event any party is aggrieved by this Order, they may file an
appeal before the Telangana Real Estate Appellate Tribunal, as per Section 44
of the RE(R&D) Act, within 60 days from the date of receipt of this Order.
