The present matter filed by the Complainant herein came up for hearing on
18.06.2024, 23.07.2024, 14.08.2024 and 17.10.2024 before this Authority and none
appeared for Complainant and the Respondent and, this Authority passes the
following ORDER:

The present Complaint has been filed by the Complainant under Section 31

of the Real Estate (Regulation & Development) Act, 2016 read with Rule (hereinafter
referred to as the “Act”) read with Rule 34(1) of the Telangana Real Estate (Regulation
and Development) Rules, 2017 (hereinafter referred to as the “Rules”) seeking
appropriate relief against the Respondent.

Complainant and the Respondent were called for hearing on 18.06.2024

wherein both parties appeared. The Complainant reiterated the contents of the
complaint, whereas the Respondent sought time for filing a detailed reply.
Accordingly, the matter was adjourned to 23.07.2024 and both parties were duly

informed of the same. However, on 23.07.2024, both parties were absent. Matter was
accordingly adjourned to 14.08.2024. On 14.08.2024, both parties failed to appear,
yet again. Therefore, fresh notices were issued to the parties to appear on
17.10.2024. On 17.10.2024, despite in receipt of the Notice for hearing, both parties
failed to appear yet again.

This Authority observes that enough opportunities have been afforded to the

Complainant to appear and submit before this Authority. Given the Complainant's
consistent absence, it is apparent that the Complainant does not seek to pursue the
matter. In lieu thereof, the present Complaint stands dismissed for non-prosecution.
