The present matter filed by the Complainant herein came up for hearing on
22.11.2023 and on 02.01.2024 before this Authority in the presence of the
Respondent in person, and none for the Complainant, and upon hearing the
arguments, this Authority passes the following ORDER:

The present Complaint has been filed under Section 31 of the Real Estate
(Regulation and Development) Act, 2016 (hereinafter referred to as the “Act”) read
with Rule 34(1) of the Telangana Real Estate (Regulation and Development) Rules,
2017 (hereinafter referred to as the “Rules”) requesting appropriate action against
the Respondent Builder.

Notice was returned as “no such person on this address” for the
Complainant for hearing on 22.11.2023. Respondent was in receipt of the Notice
and submitted Memo dated 15.11.2023 seeking time to file counter in the matter.
Matter was accordingly adjourned to 02.01.2024.

As
the notice was
incomplete on
the Complainant, this Authority
endeavoured to telephonically inform the Complainant to attend the proceedings
before this Authority to be held on 02.01.2024. The Respondent was also duly
informed of the hearing. On 02.01.2024, the Respondent, Sri Kapish Kedia
appeared and submitted, vide Memo dated 02.01.2024, that the Respondent does
not wish to file any counter as the dispute between the parties is civil in nature.
The Complainant, despite notice, failed to appear before this Authority.

Without going into the merits of the matter, as the Complainant has failed to
appear and is not pressing on the issue, the present complaint stands dismissed
for non-prosecution.

If aggrieved by this Order, the parties may approach the TS Real Estate
Appellate Tribunal (vide G.O.Ms.No.8, Dt.11-01-2018, the Telangana State Value
Added Tax Appellate Tribunal has been designated as TS Real Estate Appellate
Tribunal to manage the affairs under the Act till the regular Tribunal is established)
within 60 days from the date of receipt of this Order.
