ORDER
The present Complaint came up for hearing on 28.08.2024. The
Counsel for the Complainant filed a memo seeking permission to withdraw
the Complaint with liberty to file a fresh complaint.

As per the Complaint, the Complainant had purchased seven plots in

the Respondent's project, “Fortune Pharma City,” for which the Complainant
and the Respondent entered into an Agreement of Sale dated 11.08.2021.
The Complainant paid an amount of Rs. 56,80,000/- towards the purchase
of the said plots. However, the Respondent, till date, has not registered the
said plots in the name of the Complainant. The relief sought in the
Complaint was a direction to the Respondent to register the allotted plots in
favour of the Complainant.

On 28.08.2024, the Counsel for the Complainant submitted a memo

seeking permission to withdraw the Complaint with liberty to file a fresh
Complaint on the same cause of action, carrying necessary parties,
incorporating relevant facts, and seeking appropriate reliefs.

Upon considering the memo and the submissions made by the

Counsel for the Complainant, the Authority finds it appropriate to allow the
prayer made therein.

In view of the above facts and circumstances, the Authority hereby

dismisses the Complaint as withdrawn, with liberty to the Complainant to
file a fresh Complaint on the same cause of action, without prejudice to the
Complainant’s rights to pursue the matter further.
