This complaint came up for hearing before me on this day in the presence of Sri
Drupad Sangwan, Advocate for the complainant and after hearing and having stood over
for consideration, the following order is passed:

ORDER
The present complaint has been filed under Section 31 of the Real Estate
(Regulation and Development) Act, 2016 (hereinafter referred as “the Act”) read with
Rule 35 of the Telangana State Real Estate (Regulation and Development) Rules, 2017
(hereinafter referred as “the Rules”) to grant compensation.

The case of the complainant is that he entered into Sale Agreement dt.11.08.2021

with the respondents for purchase of Plot Nos.270, 271, 272, 273, 274, 275 and 276
total admeasuring 1372.20 Sq.yards in Sy.Nos.282/P and 283/P in Project “Fortune
Pharma City” situated at Nazdik Singaram village and Grampanchayat, Yacharam
Mandal, Ranga Reddy District, and the respondents promised spot registration. Later
on, the respondents failed to execute registered sale deed in the name of the

On registration of the complaint, notices were issued to the respondents at the

addresses furnished in the complaint. But, the notices could not be served properly.

Later, when the matter was adjourned to hear the complainant regarding

addresses of the respondents, the complainant filed a memo through his Counsel stating
inter alia that the complainant intends to file a fresh complaint with comprehensive
facts and appropriate reliefs and at last praying to permit the complainant to withdraw
the complaint with liberty to file a fresh complaint.

Heard learned Counsel for complainant.

Perused the memo. In the facts and circumstances stated in the memo, the

memo is allowed permitting the complainant to withdraw complaint with a liberty to
file a fresh complaint.

In the result, the complaint is disposed off as “withdrawn” with liberty to the

complainant to file a fresh complaint. No costs.
